Should we be thinking of using Melodic minor or diminished or both
I know it will depend if it resolves to 1 chord or not.

I would tend to lean toward the sound of harmonic minor. The 5th mode is called Phrygian dominant and was widely used by the bebop players of the 40's and 50's.

Your other suggestions would work great but a simple 7b9 chord may sound better with less alteration. The Phrygian dominant scale only contains b9 and b13.

When I play over a V7b9 I tend to use the harmonic minor scale as you said. Maybe is because it reminds me the sound of gipsy jazz and venezuelan folk music! I always thought that melodic minor and altered scale is more "authentic" to bebop and "modern" that harmonic minor. Glad to know that I was wrong.
